As between you and Spirit Rock, you own your User Content, and we own all Spirit Rock Content. Spirit Rock also owns any and all intellectual property rights in connection with the Spirit Rock Content and the Service, including any copyrights, trademarks, service marks, trade names, trade secrets, and any other proprietary rights. You are prohibited from selling, licensing, copying, publishing, modifying, reproducing, distributing, creating derivative works of, displaying, or otherwise using or exploiting the Spirit Rock Content, in any way, without our express prior written consent. Except as expressly provided in these Terms, Spirit Rock shall retain any and all rights in and to the Service and Spirit Rock Content.
You understand, acknowledge, and agree that you (a) grant Spirit Rock an irrevocable, worldwide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable license and right to use, display, modify, copy, translate, prepare derivative works of, and distribute your User Content for any purpose; (b) are not entitled to compensation for any User Content; and (c) waive any claims or assertions of moral rights with respect to User Content to the maximum extent permitted by applicable law.
Cancellations Prior to the Start Date: If you paid a registration fee for an Online Program (a “Program Fee”), and you submit your cancellation prior to the start of the calendar day on which such Online Program begins (the “Start Date”), you will have the option to either (1) receive a credit, in an amount equal to the Program Fee or (2) elect to treat such Program Fee as a donation to Spirit Rock.
Cancellations on or After the Start Date: If you paid a Program Fee, and you submit your cancellation on or after the Start Date for such program, Spirit Rock shall have no obligation whatsoever to issue you any credit or refund.
YOUR USE OF THE SERVICE, ITS CONTENT, OR ANY THIRD-PARTY CONTENT, IS AT YOUR OWN RISK. THE SERVICE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.NEITHER SPIRIT ROCK NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE OR ANY OF ITS CONTENT OR FEATURES. WITHOUT LIMITING THE FOREGOING, NEITHER SPIRIT ROCK NOR ANYONE ASSOCIATED WITH US REPRESENTS OR WARRANTS THAT THE SERVICE AND ITS CONTENT, OR ANY OF THE GOODS, SERVICES, OR BUSINESSES PROVIDED OR LINKED TO THROUGH THE SERVICE , WILL BE ACCURATE, RELIABLE, SUITABLE, APPROPRIATE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE, OR WILL BE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE OR OTHER ITEMS OBTAINED THROUGH THE SERVICE WILL OTHERWISE MEET YOUR NEEDS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPIRIT ROCK HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
NOTWITHSTANDING THE FOREGOING, NOTHING IN THIS SECTION 15 SHALL AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW

Spirit Rock Meditation Center, a California nonprofit religious corporation (“Spirit Rock,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy (as updated from time to time, this “Policy”) applies to information we collect on or through the Spirit Rock Courses website [courses.spiritrock.org], including our online teachings, programming, Dharma Library, and other features, and any other related services provided by us including our on-site events, trainings, other programming, and other on-site services (collectively, the “Service”), and through our other communications with you in connection with the Service. As used in this Policy, the terms “you,” “your,” or “user” refer to you as a user of the Service. The provisions of the Spirit Rock Courses Terms of Service [courses.spiritrock.org] (the “Terms”) also apply to this Policy. Any defined terms not defined in this Policy shall have the meanings set forth in the Terms.
This Policy describes the types of information we collect from and about you and our practices for using, protecting, disclosing, and sharing that information, as well as your choices regarding your information. Please review this Policy carefully before using the Service. By using our Service, you represent that you agree and consent to our use, disclosure, and handling of your information, as described herein.
The Spirit Rock website and online services (the “Online Services”) are not intended for children under the age of 16. By using the Online Services, you represent that you are 16 years old or older. If we learn or have reason to believe a user is under the age of 16, we will terminate that user’s account and delete any personal information in that account.
We may change, update, or replace this Policy from time to time by posting any changes or updates to the Service. If we make significant changes, we will notify users via e-mail (unless they have unsubscribed from receiving such e-mails) or by posting a banner notice on the Service. You understand and agree that your use of the Service after such changes have been posted will constitute your acceptance of and consent to the updated Policy to the extent permitted by applicable law. The information we collect about you includes information that personally identifies you (“personal information” or “personal data”), as well as other information that does not identify you (“non-identifying data”), such as statistics and general data. We reserve the right to use and disclose non-identifying data in any manner, to the extent permitted by applicable law.
For example, in order to pay program registration fees, purchase on-demand courses, or make a donation you will be required to provide your credit card information, billing address, and e-mail address in order for your payment to be processed.
To Promote Our Programs & Services: We also use your information to contact you by e-mail, through the Service, or otherwise about our services, programs, or other resources that may be of interest to you. However, you have the right to opt out of such communications, if you do not wish to receive them. For information and instructions on exercising your opt-out rights please see Section 10 below (“Your Data Choices”).
We disclose personal information collected from or about you as part of the Service to third parties for the purposes described below, as follows:
Our privacy practices are subject to applicable laws in the countries in which our users are located. In light of this, we engage in the data practices described in this Policy, with respect to a user, only to the extent such practices are permitted under the applicable law of the country where the user is located. Spirit Rock is located and operated in the United States. If you are located in a country other than the United States your information may be transferred internationally in connection with your use of and access to the Service. These steps include obtaining your express consent to the transfer of your personal information to the United States or other lawful means of transferring your personal information.

Nevertheless, Spirit Rock provides our users with a number of rights, with respect to your personal information, including the right to request access to, change, or remove your personal data, or to change your marketing preferences (as described above). Spirit Rock reserves the right to use reasonable measures to verify your identity before modifying, updating, correcting, removing, or providing access to the personal information of any user.
You can close your account at any time by sending an account termination request to srmc@spiritrock.org. If you choose to close your account, we will remove all or part of certain posts from view and/or dissociate them from your user profile or account. However, we will retain your information so long as it is needed in order to provide the Service or as otherwise permitted by applicable law. For example, we may retain information to comply with our legal obligations. We may also maintain residual copies of your information in our backup systems.
We use reasonable technical, administrative, and other measures, to (i) secure and store the information collected by us (or on our behalf) through the Service and under this Policy and (ii) to attempt to prevent the misuse of, loss of, and unauthorized access to, such information, such as access controls and password requirements. We also use industry-standard service providers, with data protection and security measures that meet industry standards, to host and store your information. All third-party service providers engaged by Spirit Rock are vetted for security, privacy, and compliance purposes. Although we strive to protect your information, we cannot guarantee the security of information submitted, collected, or received through the Service and under this Policy. The transmission of such information in connection with the Service is at your own risk.
Our Service includes links to third-party websites or services that are not operated or provided by Spirit Rock. Such third parties may collect information from or about you. We are not responsible for, and make no representation of any kind regarding, such third parties or their data practices. If you choose to click on any links to, interact with, visit, use, or otherwise engage with any third-party websites, services, or entities, you do so entirely at your own risk.
